After a visit to the Basslergut Prison in 2023, the Swiss National Commission against Torture reported that the the facility failed to properly distinguish between its administrative detention and criminal incarceration regimes, noting: "As the persons placed in administrative detention under immigration law are housed in a separate building in Bässlergut Prison, the separation requirement is largely complied with. However, there is still confusion between the penal system and administrative detention under immigration law at both an organizational and structural level. For example, both detention regimes report to the same director of Bässlergut Prison. Prison staff work alternately in administrative detention under immigration law and in the penal system, and the health service is also responsible for both types of detention. In the Commission's view, the dual deployment of prison staff entails the risk of staff adopting a prison-like attitude towards detainees in administrative detention under immigration law. The support staff in administrative detention under immigration law must."
